1. About these terms

These terms govern your use of Chinese Tone Trainer and chinesetonetrainer.com, provided by 橙語管理顧問有限公司, trading as Merry Mandarin, a company based in Taoyuan City, Taiwan (“we”, “us”). Our contact details appear below.

By using the product, you agree to these terms where they form a valid agreement under applicable law. If you do not agree, do not use it. The privacy policy explains data handling; it is not a request for blanket consent to data processing. Non-waivable consumer and privacy rights always apply.

2. Using the app

We give you a limited, non-exclusive right to install and use the app for lawful personal learning, subject to these terms and the rules of the store from which you obtain it. No Merry Mandarin account is required.

The product is intended for users aged 13 and older. If you are not legally able to enter this agreement yourself, a parent or legal guardian must authorize and supervise your use.

Use the microphone only when you have the necessary permission to record the people around you. Do not use the product to infringe others’ rights, distribute unlawful content, interfere with security, or misrepresent ownership of our software or branding. Restrictions do not prevent activities that applicable law or an open-source license expressly permits.

3. Understanding practice feedback

Microphone quality, background noise, your voice, and estimated syllable boundaries can affect results. Tone guides are teaching curves, not measurements of a native speaker saying each phrase. Synthesized pronunciation, dictionary entries, and automatic tone-sandhi readings may contain errors or require context. You can review readings and adjust phrase boundaries.

The product does not promise a particular score, learning outcome, examination result, or level of fluency. It is not a certification or a substitute for a qualified teacher’s assessment.

4. Your content and local data

You retain your rights in sentences and recordings you create. We do not acquire ownership of them or a right to publish them merely because you practice with the app. You are responsible for having the rights necessary to use content you enter or record.

Your saved sentences and practice history are stored locally. There is no account-based cloud synchronization or recovery service. Clearing storage, deleting the app, device failure, or changing devices may remove your history. Our privacy policy explains local retention and deletion.

If you contact support and deliberately provide a message or attachment, we may use it to address that request. Do not send content that you do not want our support team to receive.

5. Availability and purchases

Platform availability, supported operating systems, device requirements, and any price are stated in the relevant store listing at the time of download or purchase. This website may describe a product or platform that is still being prepared. It is not a promise of a release date.

If you buy the app or a paid feature, the store’s checkout shows the applicable price and purchase conditions. Any subscription, if offered in the future, must disclose its duration, renewal, and cancellation conditions before you agree to purchase it. These terms do not create a subscription or authorize a charge.

Store transactions are subject to the applicable Google Play or Apple App Store terms. Refund and cancellation requests can be made through the store’s procedures or by contacting us for assistance. Nothing here limits statutory withdrawal, refund, warranty, or other consumer rights.

We provide product support at [email protected]. We do not guarantee compatibility with every device or indefinite support for every operating-system version.

6. Ownership and open-source components

Except for your own content and third-party material, the product’s software, design, branding, and original content belong to us or our licensors. Your license to use the app does not transfer those rights.

The app includes components with their own licenses. Those licenses govern the relevant components and prevail over conflicting restrictions in these terms. In particular:

• CC-CEDICT: Chinese dictionary data from MDBG and community contributors, licensed under Creative Commons Attribution-ShareAlike 4.0. The app’s dictionary pack includes selected, reorganized entries and normalized indexes. See CC-CEDICT and the app’s notices.
• MeloTTS: the bundled voice uses MeloTTS by MyShell.ai, with the applicable MIT license and model notices included in the app.
• Fonts and libraries: Inter and Noto use the SIL Open Font License; other dependencies have their respective licenses.

Attributions and license texts are available under Settings → Dictionary & licenses. Open-source terms do not grant a right to use Merry Mandarin trademarks as your own.

7. Responsibility and consumer protections

We take reasonable care in providing the product, but software, dictionary data, and automated feedback may contain mistakes and may occasionally be unavailable. To the extent permitted by applicable law, we make no additional promise that the product will be error-free or meet every individual learning need.

Nothing in these terms excludes or restricts liability that cannot lawfully be excluded or restricted, including applicable statutory guarantees, liability for fraud or intentional misconduct, and other mandatory consumer protections. Where the law allows a limitation, we are not responsible for losses that were not reasonably foreseeable from a breach or that arise from use outside the purpose of personal language learning.

Links to third-party websites and stores are provided for convenience. Their operators are responsible for their own services and policies. Following a link does not transfer responsibility for our product to that provider.

8. Updates and ending use

We may release updates to improve functionality, security, or compatibility. We will provide any updates and notices required by law. Material changes to these terms will be communicated appropriately and will not retrospectively remove rights you have already acquired. Where a change requires your agreement, we will seek it.

You may stop using the product at any time. Delete the app and its local data if you no longer want them. We may terminate the license for a material breach of these terms, subject to any notice, opportunity to remedy, or other protection required by law. Provisions that reasonably need to survive, such as ownership and accrued rights, continue to apply.

9. Applicable law and disputes

The laws of the Republic of China (Taiwan) apply, without depriving you of mandatory consumer protections in your country of habitual residence. Where a jurisdiction agreement is legally permitted, disputes may be brought before the Taiwan Taoyuan District Court. This does not prevent a consumer from using courts or remedies available under mandatory local law.

Please contact us first if there is a problem so we can try to resolve it. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law. Translations, if provided, are for convenience; mandatory local language and consumer-law requirements take precedence.
